Welcome to thegivingangel.com.au. This website is operated by The Giving Angel Pty Ltd (ABN 13 684 373 733). By browsing or purchasing through our site, you agree to the following terms, our Privacy Policy, and relevant Australian laws. If you have any questions, contact us at hello@thegivingangel.com.au.

1. Prices, Payment & Ordering

All prices are in Australian Dollars (AUD) and include GST. Delivery costs are calculated at checkout.

You can pay securely via Visa, Mastercard, American Express, UnionPay or JCB.

Placing an order confirms that you are authorised to use the selected payment method. Prices may change, but confirmed orders are final.

To place an order, simply select your angel, complete the checkout steps, and provide accurate contact and delivery details. Orders are subject to availability and acceptance.

We reserve the right to cancel or reject orders that:

  • Are flagged as suspicious or high-volume
  • Contain errors in price or description
  • Cannot be fulfilled due to stock or delivery issues

2. Delivery & Address Requirements

We deliver across Australia. Same-day delivery is available within Melbourne metro for orders placed before 12PM AEST Monday to Friday, and before 10AM AEST Saturday. Standard and express options are available elsewhere. PO Boxes and hospital deliveries are possible with clear recipient details.

To help ensure smooth delivery:

  • Provide a correct and complete address
  • Ensure the recipient is available or there is a safe place to leave the parcel
  • If delivery fails due to an incorrect address or no safe access, the parcel may:
    Be redirected to a local collection point
    Be returned to us (redelivery or return fees may apply) 

3. Delivery Limitations

  • Undeliverable Items: Parcels may be refused, redirected, or returned. Additional fees may apply.
  • Incorrect Addresses: We are not liable for errors caused by incorrect or incomplete address information. If re-delivery is required a payment may be charged.

4. Cancellations & Refunds

If your angel arrives damaged or there is an issue with your order, please contact us within 48 hours. We may offer a replacement, store credit, or refund in line with Australian Consumer Law.

Because each angel gift includes a charitable donation passed on in full to your chosen charity, donations are non-refundable once processed.

In exceptional circumstances, such as an accidental duplicate order, we will review requests on a case-by-case basis and do our best to assist.

Please note that refunds are not available for change of mind or incorrect delivery details.

5. Product Variations & Substitutions

Each angel is handmade, so slight variations occur. Every angel uses a unique bunch of flowers based upon seasonal availability and we cannot accommodate any requests as to use of a particular flower or colour scheme.

Please note: Angels are delicate keepsakes designed for display. They are not toys and should not be handled roughly, dropped, or exposed to moisture or extreme temperatures. The Giving Angel is not responsible for damage incurred caused by mishandling after delivery. Any damage that has occurred will be dealt with case by case, taking into account each of our rights and responsibilities under the Australian Consumer Law.

6. Your information, communications and marketing  

The contact details you provide may be used to contact you regarding your order. We will otherwise manage all information you provide in accordance with our Privacy Policy.

You will receive emails from us regarding your order, your donation and its impact, and promotional and marketing material. You can opt to not receive further emails at any time using the unsubscribe link, or by reply email.

7. Ownership & Intellectual Property

All content on this site, including images, text, logos, and designs, is owned or licensed by The Giving Angel Pty Ltd. The angel’s concept, design, and presentation are proprietary and protected under Australian intellectual property laws. Please don’t reproduce, copy, or imitate without permission.

8. Legal Stuff

These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in Victorian courts. We’re not liable for indirect or consequential losses, and our maximum liability is limited to the amount paid for the product in question. Your statutory rights under Australian Consumer Law remain unaffected.

We may update these terms from time to time. The version published at the time of your order will apply.
