1. Promoter
The promoter is The Giving Angel Pty Ltd (ABN 13 684 373 733), Victoria, Australia, referred to in these Terms and Conditions as “The Giving Angel”, “we”, “us” or “the Promoter”.
The Promoter can be contacted at hello@thegivingangel.com.au or through thegivingangel.com.au.
2. Purpose and nature of the promotion
The Giving Angel is conducting an online promotional charity vote through its official Instagram account, @thegivingangel.
The participating charity that receives the highest number of valid votes will receive a $1,000 donation from The Giving Angel.
The donation is funded by The Giving Angel. No donation, entry fee or purchase is required from voters.
This promotion is intended to raise awareness of the participating charities and promote engagement with The Giving Angel. The Giving Angel may receive commercial benefits through increased social media followers, likes, comments, shares, engagement and brand awareness.
The outcome is determined by skill and participation, specifically the number of valid votes received by each participating charity. It is not determined by chance or a random draw.
Individual voters do not receive a prize, financial benefit or other reward.
3. Promotion period
The promotion opens at 9:00 am AEST on 23 September 2026.
The promotion closes at 11:59 pm AEDT on 23 October 2026.
Votes received outside the promotion period will not be counted.
The recipient charity is expected to be announced at approximately 9:00 am AEDT on 24 October 2026, unless additional time is required to verify votes or conduct a tie-break vote.
The Promoter may reasonably amend these dates if circumstances outside its control affect the promotion. Any amendment will be announced through the official @thegivingangel Instagram account.
4. Voter eligibility
To submit a valid vote, a person must:
a. be at least 18 years of age;
b. reside in Australia;
c. have a genuine Instagram account;
d. comply with these Terms and Conditions; and
e. not be an employee of The Giving Angel or an immediate family member of an employee of The Giving Angel.
Employees, volunteers and supporters of participating charities may vote, provided they comply with these Terms and Conditions and vote using a genuine personal account.
5. How to vote
To submit a vote, an eligible person must:
a. follow @thegivingangel on Instagram;
b. locate the original Charity Vote post published by @thegivingangel;
c. comment directly on that original post; and
d. tag the official Instagram account of one participating charity listed in clause 8.
The person must continue following @thegivingangel at the time voting closes for their vote to remain valid.
Only comments made directly on the original Charity Vote post will be counted. Comments made on shared posts, stories, advertisements, other accounts or duplicate posts will not be counted.
Likes, shares, story mentions and additional comments are welcomed but do not count as additional votes.
By submitting a vote, the voter agrees to these Terms and Conditions.
6. Valid votes
Only one valid vote per person is permitted.
A person must not use multiple, duplicate, false, automated or misleading accounts to submit additional votes.
If a person submits more than one vote, only their first otherwise valid vote will be counted.
A valid vote must:
a. be submitted during the promotion period;
b. be posted by an eligible voter;
c. tag exactly one official participating charity account;
d. be posted directly on the original Charity Vote post;
e. remain visible when votes are verified; and
f. comply with Instagram’s rules and community guidelines.
A comment tagging more than one participating charity will be invalid.
A comment that names a participating charity without using the @ tag for its official Instagram account will not be counted as a valid vote.
A comment that tags an account other than the official participating charity accounts listed in these Terms and Conditions will not be counted as a valid vote.
The Promoter may exclude any vote that it reasonably believes is fraudulent, automated, duplicated, purchased, manipulated, generated through a fake account or otherwise inconsistent with these Terms and Conditions.
Participating charities may share the promotion and encourage genuine supporters to vote. They must not purchase votes, use automated voting methods, create false accounts or offer voters a financial incentive in return for votes.
7. Determining the recipient charity
After the promotion closes, the Promoter will count and verify the valid votes received by each participating charity.
The participating charity with the highest number of valid votes will receive the $1,000 donation.
Votes may be counted using platform information, manual review or a reputable third-party tool. The final tally will be checked by a second person before the result is announced.
If two or more charities receive the same highest number of valid votes, a 24-hour tie-break vote will be conducted between the tied charities.
If the tie remains after the tie-break vote, the $1,000 donation will be divided equally between the tied charities.
No random selection or other chance-based method will be used to resolve a tie.
Subject to applicable law, the Promoter’s determination regarding voter eligibility, vote validity and the final count is final.
The Promoter will retain a record of the final vote tally for at least 90 days after the announcement.
